Terms of Service

1. Eligibility & Age Requirement

You must be at least 18 years old to create an account or access the Platform. By registering, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into this agreement. Funvertex reserves the right to request government-issued identification at any time to verify age or identity, and to suspend an account pending verification.

2. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate registration information and keep it up to date. One person may not maintain more than one Fan account, and Creator accounts are subject to identity verification before payouts are enabled.

3. Creator Content

Creators retain ownership of the content they upload ("Creator Content"). By posting Creator Content, you grant Funvertex a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content solely as necessary to operate the Platform (including generating blurred previews and applying an attribution watermark to uploaded photos). You represent that you own or have all necessary rights to the content you upload, and that it does not infringe any third party's rights.

Creators are solely responsible for ensuring their content complies with applicable law, including age-verification and record-keeping requirements (such as 18 U.S.C. §2257 where applicable) for any performers depicted in their content.

4. Payments, Wallet & Subscriptions

Fans fund an in-platform wallet balance via our payment processor (Stripe) and spend that balance on subscriptions, pay-per-view unlocks, and tips. Subscriptions renew automatically at the listed price until cancelled. Creators earn a share of revenue generated from their content, subject to the platform fee disclosed in your Creator dashboard, and may request payout to a connected bank account once identity verification is complete.

All payments are final. Because digital content is delivered immediately upon unlock, purchases are generally non-refundable except where required by law or at Funvertex's sole discretion.

5. Prohibited Content & Conduct

You may not use the Platform to upload, send, or solicit:

• Content depicting anyone under the age of 18, however produced or depicted.
• Non-consensual content, or content depicting real people without their consent.
• Content involving violence, bestiality, or content illegal in the jurisdictions Funvertex operates in.
• Harassment, hate speech, or threats directed at another user.
• Impersonation of another person or entity, or fraudulent payment activity.
• Malware, unauthorized scraping, or attempts to circumvent paywall or watermarking protections.

Violations may result in content removal, account suspension, or permanent termination, and may be reported to law enforcement where required.

6. Reporting & Blocking

Users can report content or accounts for review, and may block another account to prevent messaging, following, subscribing, or viewing each other's profile. Funvertex reviews reports and may take action including content removal or account suspension at its discretion.

7. Termination

You may deactivate your account at any time from Settings. We may suspend or terminate your access to the Platform, with or without notice, for violation of these Terms, suspected fraud, or as required by law. Outstanding creator balances at the time of termination for cause may be withheld pending investigation.

8. Disclaimers & Limitation of Liability

The Platform is provided "as is" without warranties of any kind. Funvertex is not responsible for content posted by users. To the maximum extent permitted by law, Funvertex's aggregate liability arising out of your use of the Platform will not exceed the amount you paid us in the twelve months preceding the claim.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified in-app or by email; continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
